I. Definitions
- Eveneum - Eveneum sp. z o. o. sp. k. with its registered office in Młodziejowice 9 Słoneczny Stok Street, 32-091
Michałowice, entered in the Register of Entrepreneurs of the National Court Register by the District Court for Kraków Śródmieście, XI Economic Division under KRS number 0000469045, holding NIP 513023535.
- Ordering Party - a natural person who is not a consumer within the meaning of Article 221 of the Civil Code, a legal person or an organisational unit without legal personality, referring a Participant to participate in the Workshop.
- Participant - an individual, as designated by the Awarding Authority, attending a workshop.
- Service - means a service aimed at the acquisition or consolidation of skills or competences by the
Participants and consultancy services to support the Contracting Authority in achieving its business objectives or the objectives set for Participants by the Contracting Authority
II. Principles of cooperation and liability of the parties
- Eveneum undertakes to provide the Service in a reliable and timely manner to the best of its knowledge and
applicable, to the scope of the contracted work, provisions of applicable law.
- Eveneum declares that the persons delegated to conduct the Workshop on behalf of the Contracting Authority have the knowledge and experience necessary for the proper conduct of the Workshop.
- Eveneum may entrust the conduct of the Workshop to a third party without the need for the Purchaser's consent. Eveneum shall be liable for the acts and omissions of the third party as for its own acts and omissions.
III. Application for training
- In order to participate in the Workshop, the Ordering Party must send Eveneum a completed Workshop Application Form. The form can be submitted via email or online form.
- By completing and submitting an application for participation in the Workshop, the Ordering Party accepts the terms and conditions of the Workshop resulting from the Purchase Order and these General Conditions.
- Upon receipt of an application, Eveneum shall send confirmation of the Participant's enrolment on the list of Workshop participants without delay, no later than within 5 working days. Enrolment on the list of Workshop participants is equivalent to the reservation of a place for the Participant at the Workshop.
IV. Payment terms
- Eveneum will invoice the Ordering Party for participation in the Workshop. The value of the invoice will be the product of the number of participants registered by the Ordering Party and the net unit price.
Workshop.
- The due date of the invoice is indicated on the document.
- In the event of a delay in receiving payment for an invoice, Eveneum reserves the right to
to charge statutory interest for each day of delay and charge it to the Purchaser.
V. Copyright
- The content of the workshop materials made available/submitted to the Contracting Authority by the
Eveneum during the Workshop are the subject of the Organiser's copyright.
- By providing the Workshop service, Eveneum transfers to the Ordering Party the sole ownership of
copies of the works referred to in paragraph 1 of this section made available or
provided to the Workshop Participants on behalf of the Contracting Authority. The delivery of the Workshop service shall not
shall neither transfer any copyright nor grant any licence to the Purchaser.
- The price for workshop materials includes in particular the remuneration for the transfer of rights
ownership of the copy.
- The Contracting Authority shall be entitled to use the copies of the works referred to in paragraph 1 of this section exclusively for its own internal use, without the right to make these copies available to third parties, and the Contracting Authority shall not be entitled to provide training by internal trainers using the workshop materials referred to in this section.
VI. Cancellation and resignation from the Workshop
- If a participant cancels the Workshop within 21 days prior to the Workshop, 100% of the amount paid will be refunded.
- In the event of a participant cancelling the Workshop 14 to 21 days before the Workshop starts
50% of the amount paid will be refunded.
- In the event of a participant cancelling less than 14 days before the Workshop begins
the amount paid is non-refundable.
- In points 1 and 2, the date of receipt of the letter at Eveneum is decisive.
- If the Ordering Party does not submit a cancellation and the participant is not present at the Workshop, subject to clause 5, Eveneum will charge the Ordering Party the full cost of the training.
- In the event that the Participant is unable to attend the Workshop for reasons beyond the Participant's control, Eveneum shall allow another Participant designated by the Ordering Party to attend the Workshop, provided that the Ordering Party informs the Participant no later than 3 working days before the Workshop date.
- Eveneum reserves the right to change the date, venue or to cancel the workshop no later than 3 working days before the workshop date. In the event of cancellation, the ordering party is entitled to a 100% refund of the amount paid or to exchange the date of the workshop.
- Eveneum reserves the right to modify the programme of the Workshop, in content
justified cases.
VII. Basic information about the Service
- Eveneum undertakes to prepare and carry out the service in accordance with these General Terms and Conditions of Services.
- The duration of the Service shall be specified in hours, with the duration of the Service, including breaks, not exceeding 8 clock hours in any one day unless otherwise agreed in justified cases and upon agreement with the Client.
- Eveneum reserves the right to modify the programme of the Service substantially
justified cases.
- The implementation of the Service concludes with an evaluation of Participants' satisfaction, which includes at least the following elements:
a. assessment of participant satisfaction
b. assessment of the trainer
c. asking about areas for improvement Service
d. question about additional competences the Participant would like to develop
Findings from the evaluation are discussed with those involved in the Service and used to further develop staff and improve Eveneum's services.
- Each Participant shall receive materials prepared by Eveneum containing the Service script, if applicable to the selected Service.
- After the Service, Eveneum will prepare a personal certificate for each Participant confirming
implementation of the Service, if applicable to the selected Service.
- In order to provide participants with a reliable service and a smoothly organised service, Eveneum provides
the following resources for its implementation:
a. a content supervisor responsible for overseeing the content and outcomes of the training or other service,
b. an organisational coordinator responsible for information management, customer contact and
organisation of the service
c. the expert performing the service, an Eveneum employee or a trainer cooperating with Eveneum who has
relevant business experience and practice related to the implementation of the Service.
The tasks listed above may, where appropriate, be carried out by a single person.
- In the case of onsite Services, where Eveneum is responsible for providing the venue for the Service, we aim to ensure that the venue always meets the following conditions:
a. space appropriate to the size of the group, access to daylight and lighting
artificial
b. comfortable air temperature,
c. no disruptive external noise,
d. maintenance,
e. access to sanitary facilities,
f. furnishings (chairs, tables if necessary) to enable the space to be arranged in a manner appropriate to the
the specifics of the training,
g. provide a sense of discretion where necessary and make it possible to carry out
personal interviews
VIII. Treatment of service quality and complaints
Eveneum's services are continuously and continuously evaluated by Participants. This allows us to
increase the level of satisfaction of our customers. Irrespective of the following provisions Eveneum will always
seeks to resolve any complaints amicably, putting your satisfaction first
The Contracting Authority and the value to the Participants. In the event of objections or complaints, the Awarding Authority shall have
Right:
a. raise their concerns with the organisational coordinator and the mentor

b. access to the evaluation of the satisfaction of Participants carried out
c. if the overall average satisfaction rating of the Participants delegated by the Contracting Authority is
less than 50% Eveneum will compensate the Purchaser in one of the forms:
i. hold a follow-up session to remedy the shortcomings identified and agreed with Eveneum
ii. Financial, up to 50% of the value of the Service
IX. Protection of personal data
The controller of your personal data is Eveneum. The data will be processed for the purpose of carrying out
contracts concluded with Eveneum and the legal obligations arising therefrom, as well as for information and marketing purposes related to the services provided. The data subject has the right, at any time, to permanently delete his/her personal data, to correct them or to restrict the processing by notifying Eveneum of such decision by sending a message to the following address

Personal data will be processed by the Administrator on the basis of RODO Article 6(1) when:
- the data subject has given his or her consent to the processing of his or her personal data for one or more specified purposes
- the processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract
- processing is necessary for compliance with a legal obligation to which the controller is subject
- the processing is necessary to protect the vital interests of the data subject or of another
individual
- processing is necessary for the performance of a task carried out in the public interest or in the
in the exercise of official authority vested in the controller
- processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
Period of retention of personal data:
- personal data processed on the basis of the legitimate interest of the Controller will be
kept for the duration of the contract for the period necessary for:
- complaint handling
- secure or assert possible claims against the Administrator, or
against the Administrator
- to comply with a legal obligation of the Administrator (e.g. arising from tax legislation or
accounting);
- personal data processed on the basis of a separate consent will be kept until that consent is given
cancellations
Rights of the personal data subject:
- the right of access to the content of your personal data, i.e. the right to obtain confirmation of whether or not
The controller shall process the data and information relating to such processing
- the right to rectification of data where the data processed by the Controller is inaccurate or
incomplete
- the right to ask the Controller to delete data
- the right to request the Controller to restrict data processing
- the right to data portability, i.e. the right to receive the data provided to the Controller
personal information and to send it to another controller;
- the right to object to the processing of your data (except where your data
are processed on the basis of legal provisions and their necessary archiving period has not expired)
- the right to lodge a complaint with the Polish supervisory authority or with the supervisory authority of another country
Member State of the European Union with jurisdiction over the data subject's habitual place of residence or work or over the place of the alleged breach of the RODO
- the right to withdraw consent at any time (without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal)
- the right to obtain human intervention on the part of the Controller, to express one's point of view and to contest a decision based on automated data processing
The rights set out in (1)-(6) and (8)-(9) above may be exercised, inter alia, by contacting the Data Protection Officer (address provided in the introduction) or by contacting the Controller by letter (address provided in the introduction, marked „Data Protection”).
Personal data may be processed on behalf of the Controller by employees and associates authorised by the Controller who need to have access to the data to perform their duties.
X. Final provisions
1 These General Terms and Conditions of Competency Development Services form an integral part of the contract.
(2) Any disputes arising from contracts concluded on the basis of these General Terms and Conditions shall be settled by the court having jurisdiction over Eveneum's registered office.
3 The General Terms and Conditions of Competence Development Services are effective as of 01.01.2020.
